TripDeck Terms of Service

These Terms of Service ("Terms") govern your use of TripDeck. Please read them carefully. By creating an account or using TripDeck, you agree to these Terms. If you don't agree, don't use the service.
TripDeck is operated as a sole proprietorship by Christopher S. Dye, based in Waverly, Illinois, United States ("TripDeck," "we," "us," or "our"). You are "you" or "the user."
1. What TripDeck is
TripDeck is a productivity tool for people who attend business trips — trade shows, expos, site visits, customer meetings — and want to turn those trips into structured reports. TripDeck captures business cards, dictated notes, and other trip artifacts, then generates polished trip reports and engagement reports.
Bring-your-own storage. TripDeck stores your trip data in your own cloud storage account (Google Drive, OneDrive, or Dropbox). We do not keep copies of your trip content on our servers. What this means for you:
- Your trip data belongs to you and stays in your storage
- If TripDeck disappears tomorrow, your data is still in your storage
- If your storage provider disappears or you lose access to it, TripDeck cannot recover your data
- The reliability of your storage is your storage provider's responsibility, not ours
2. Accounts
To use TripDeck you must:
- Be at least 16 years old
- Provide accurate account information
- Keep your password confidential — you're responsible for activity under your account
- Connect a supported storage provider (or accept that TripDeck functionality is limited without one)
You may not create accounts for anyone other than yourself without authorization, share your account credentials, or use TripDeck to impersonate someone else.
3. Acceptable use
Use TripDeck for its intended purpose — organizing your own business trips and the contacts you meet on them. Don't use TripDeck to:
- Violate any law or the rights of others, including data protection laws where you collect contact information
- Upload or process content you don't have the right to process (this includes business cards, notes about people, and audio recordings — you're responsible for having the appropriate legal basis to collect and process contact data under laws like GDPR, CCPA, or equivalent)
- Attempt to gain unauthorized access to TripDeck, its infrastructure, or other users' accounts
- Reverse-engineer, decompile, or interfere with the service beyond what is necessary for normal use
- Send spam, malware, or automated abuse through any TripDeck feature that generates outbound communication
- Use TripDeck in a way that would cause it to violate the terms of any third-party service it depends on (Google API terms, Microsoft Graph terms, Dropbox API terms, our AI providers' terms)
If you violate these rules we may suspend or delete your account without notice.
4. Your content and licenses
You own your content. TripDeck does not claim ownership of any trip data, contact information, business cards, notes, reports, or other content you upload or generate through the service. Your content stays in your storage provider under your account.
License to us. To operate TripDeck, you grant us a limited, non-exclusive license to read, process, transmit, and modify your content solely as needed to provide the service — for example, reading a business card image so we can extract contact fields, then writing the structured contact back to your storage. This license ends when you delete the content or disconnect storage.
No training. We do not use your content to train AI models. We do not permit our AI service providers to train on your content under our API agreements with them.
5. Third-party services
TripDeck integrates with services controlled by other companies:
- Storage providers — Google Drive, Microsoft OneDrive, Dropbox
- AI providers — OpenAI or equivalent LLM services for card OCR, transcription, and report generation
- Payment processor — Stripe for paid plans (when subscriptions launch)
- Infrastructure — Cloudflare for hosting and network security
Your use of TripDeck is subject to those services' terms of service and privacy policies. TripDeck is not responsible for the availability, accuracy, or behavior of third-party services. If a storage provider changes its API, loses your data, or terminates your account, TripDeck cannot make you whole for what that provider does.
6. Fees, subscriptions, and refunds
TripDeck plans to offer both free and paid tiers. As of the effective date of these Terms, no paid tier is generally available. When subscriptions launch:
- Subscription fees will be posted at gettripdeck.com/pricing
- Subscriptions renew automatically unless canceled before the renewal date
- You can cancel any time from account settings; cancellation takes effect at the end of the current billing period
- Refunds: we offer a full refund within 30 days of your first paid subscription, no questions asked. After that, fees are non-refundable except where required by law.
Prices may change with 30 days' notice by email to your account address.
7. AI-generated content
TripDeck uses large language models to generate trip reports, engagement summaries, and other artifacts. AI-generated content may contain errors, misinterpretations, or fabrications. You are responsible for reviewing any AI-generated output before relying on it or sharing it externally. TripDeck is a drafting assistant, not a source of truth.
8. Availability and changes to the service
TripDeck is provided on an "as-is" basis. We aim for high availability but do not guarantee uninterrupted service. We may:
- Add, change, or remove features
- Modify pricing (with the notice required by Section 6)
- Suspend the service for maintenance
- Discontinue the service entirely, with at least 30 days' notice by email so you can retrieve any data still on our servers (your storage-provider data stays where it is)
We are not liable for interruptions, delays, or failures caused by third-party services, force majeure, or events outside our reasonable control.
9. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, TRIPDECK IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED CONTENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Your use of the service is at your own risk. You are responsible for maintaining backups of any data you consider important.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL TRIPDECK OR CHRISTOPHER S. DYE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to defend, indemnify, and hold harmless TripDeck and Christopher S. Dye from any claim, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the service, your content, or your violation of these Terms or applicable law — including data protection laws relating to the contact information you process through TripDeck.
12. Termination
You may stop using TripDeck at any time by deleting your account. We may suspend or terminate your account at any time if you violate these Terms or misuse the service.
On termination:
- Account data on TripDeck's servers is deleted (see Privacy Policy for details)
- Files in your own storage stay in your storage — you keep them
- The following sections survive termination: 4 (Your content and licenses, for content you shared before termination), 9 (Disclaimers), 10 (Limitation of liability), 11 (Indemnification), 13 (Governing law and disputes)
13. Governing law and disputes
These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-law rules. Any dispute arising out of or related to these Terms or your use of TripDeck will be resolved exclusively in the state or federal courts located in Illinois, and you consent to the personal jurisdiction of those courts.
Nothing in this section prevents either party from seeking injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property rights.
14. Changes to these Terms
We may update these Terms. Material changes will be announced by email to your account address at least 14 days before they take effect, and the "Last updated" date at the top will change. Continuing to use TripDeck after a change means you accept the updated Terms. If you don't accept them, stop using the service and delete your account.
15. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy at gettripdeck.com/privacy are the entire agreement between you and TripDeck concerning the service.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign these Terms without our consent. We may assign them, for example if TripDeck is sold or reorganized.
